The term infringement means breach of law or violation of right. The owner of copyright work has exclusive right to do certain acts in respect of work. If without authorisation or license from the owner any person does any act which violates the work of the owner, it amounts to infringement of copyright. The natures of the rights depend upon the nature of the work. In order to decide whether there is an actual infringement or not it is to be taken into consideration whether there is a reproduction of the work or substantial part of it in any material form whatsoever. In order to prove infringement the applicant has to show similarity between two marks, unlawful use of applicant's mark(directly or indirectly) and that the defendant has access to the applicant's work.
